Section 504 is a federal civil rights law that prohibits discrimination and mandates comparable treatment and equal access / opportunity. 34 C.F.R. Part 104.49(a) states that no qualified handicapped person shall, on the basis of handicap, be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives or benefits from Federal assistance.
Section 504 applies to all recipients of federal funds and is enforced by the Office for Civil Rights (OCR). This federal agency investigates complaints or allegations of non-compliance with the law. In general, any agency or institution which directly receives any federal money for any reason is required to comply with Section 504. Violators can lose federal funds, but more often are required to take corrective action.
Section 504 guarantees a free appropriate public education (FAPE) for students with disabilities in public schools. "Appropriate" requires that students with disabilities be provided with necessary accommodations, which Section 504 defines as regular or special education and related aids and services that (I) are designed to meet the individual educational needs of handicapped persons as adequately as the needs of nonhandicapped persons are met. It also requires that students with disabilities be provided with an education comparable to that provided to students without disabilities. Schools must provide access to programs and facilities that offer an opportunity for meaningful participation for qualifying individuals with disabilities (e.g., ramps to provide access for wheelchairs, support/accommodations for students participating in extracurricular activities, interpreters for parents with hearing impairments when attending parent/teacher conferences or school plays).
